MADISON – The Center for Media and Democracy, a Madison-based nonprofit, sued the state Department of Justice (DOJ) this week for its refusal to release nearly 2,000 emails related to Attorney General Brad Schimel’s attempt to find the Affordable Care Act unconstitutional.
Two weeks after the center requested the records, the DOJ’s Paul Ferguson responded that it would be “excessively burdensome” to review and redact the 1,940 emails identified as possibly relevant.
“Wisconsin’s Open Records Law has a strong presumption of public access,” said Pines Bach attorney Christa Westerberg, who is representing CMD. “The Department’s denial is a burden on the public’s right to know on a matter of obvious public concern.”
